Subrogation Litigation
During the course of an insurance claim, the time often comes to pursue other parties for their fault in causing or contributing to a covered loss. We review every first party insurance claim and every lawsuit for subrogation potential and, when appropriate, recommend prosecution of recovery claims within ongoing litigation or in separate litigation. We have pursued recovery claims and litigation across the United States from Arizona to Puerto Rico, for amounts ranging from a few hundred thousand dollars to more than fifty million dollars, often addressing complex technical, legal, and procedural issues, for losses on land and on water. In some cases, the review yields insufficient subrogation potential, and we only recommend pursuit of subrogation recovery when it is economically feasible relative to litigation costs. In all cases, we place the best interest of our clients at the forefront of our subrogation analysis and advice.
